By downloading, installing, or using EasyCapture Pro ("Software", "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

2. Description of Service

EasyCapture Pro is a screenshot capture application for Windows that provides:

• Screen region and full-screen capture functionality
• Local screenshot storage
• Cloud upload and sharing capabilities
• Automatic updates

3. User Responsibilities

By using our Service, you agree to:

• Use the Service only for lawful purposes
• Not capture or share content that violates others' rights
• Not attempt to circumvent security measures
• Not use the Service to distribute malware or spam
• Not overload or disrupt our servers or networks
• Comply with all applicable laws and regulations

4. Acceptable Use

You may not use our Service to:

• Violate any laws or regulations
• Infringe intellectual property rights
• Transmit harmful, offensive, or illegal content
• Harass, abuse, or harm others
• Distribute content involving minors inappropriately

We reserve the right to remove content and suspend access for violations.

5. Intellectual Property

The Software, including its code, design, graphics, and documentation, is owned by EasyCapture Pro and protected by copyright and other intellectual property laws.

Your screenshots and uploaded content remain your property. By uploading content, you grant us a limited license to store and transmit it as necessary to provide the Service.

6. Cloud Service

Our cloud upload service is provided as a convenience. We reserve the right to:

• Set storage limits and retention periods
• Remove content that violates these Terms
• Modify or discontinue the service with reasonable notice
• Rate limit uploads to prevent abuse

We are not responsible for loss of uploaded content. We recommend keeping local backups of important screenshots.

7. Updates

The Software may automatically download and install updates. These updates are designed to improve functionality and security. By using the Software, you consent to automatic updates.

8. Privacy

Your privacy is important to us. Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will meet your requirements
• The Service will be uninterrupted, timely, secure, or error-free
• Results from using the Service will be accurate or reliable
• Any errors will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYCAPTURE PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Cost of substitute services
• Any other intangible losses

Our total liability shall not exceed the amount you paid for the Service (if any).

11. Indemnification

You agree to indemnify and hold harmless EasyCapture Pro and its affiliates from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you capture or share using the Service

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your uploaded content
• Provisions that should survive termination will remain in effect

13. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes through the Software or on our website. Your continued use after changes constitutes acceptance.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and EasyCapture Pro regarding the Service.
